Pharmaceutical Invoicing: Complete FBR Compliance Guide
Why Pharmaceutical Invoicing is Different
Pharmaceutical businesses operate under overlapping regulatory frameworks:
- FBR (Federal Board of Revenue): Sales tax invoicing through Digital Invoicing, sales tax returns, income tax
- DRAP (Drug Regulatory Authority of Pakistan): Drug registration, manufacturing and sales licences, labelling, recalls
- Provincial health departments: Drug sale licences for pharmacies and distributors
- Narcotics control: Controlled substances under the Control of Narcotic Substances Act 1997, administered separately from FBR
The result: pharmaceutical invoicing requires dual compliance, with FBR tax rules on one side and drug regulatory requirements on the other. This guide focuses on the FBR side and explains where the two do and do not overlap.
Pharmaceutical HS Codes (Classification)
Every medicine has a Harmonized System code for tax purposes. FBR expects the 8-digit Pakistan Customs Tariff code (format 1234.5678) chosen from FBR's reference data. The main pharma headings, in ascending order:
| Category | HS Heading | Example 8-digit Code | Tax Treatment |
|---|---|---|---|
| Active pharmaceutical ingredients (APIs) | 2936–2942 | 2941.1000 (penicillins) | Many APIs have their own entries; check the current schedule/SRO |
| Vaccines, blood products, immunological products | 3002 | 3002.4100 | Check the current schedule/SRO |
| Medicaments not in measured doses (bulk) | 3003 | 3003.9000 | Check the current schedule/SRO |
| Medicaments in measured doses (tablets, capsules, syrups, injections, creams) | 3004 | 3004.1000 (penicillins), 3004.3100 (insulin) | Registered drugs: fixed, non-adjustable rate under the Eighth Schedule, serial 81; check the current schedule/SRO for the rate |
| Pharmaceutical goods (sutures, dressings, first-aid kits) | 3006 | 3006.1000 | Check the current schedule/SRO |
| Diagnostic reagents and kits | 3822 | 3822.1900 | Check the current schedule/SRO |
Critical note: Most registered drugs are not taxed at the standard 18% rate. They carry a fixed, non-adjustable sales tax rate under the Eighth Schedule (serial 81), and the Digital Invoicing API has a matching sale type ("Non-Adjustable Supplies", sandbox scenario SN025). Use the correct HS code and sale type together; a mismatch returns an FBR error code rather than a silently wrong invoice.
Batch Numbers and Expiry Dates: DRAP, Not FBR
DRAP rules require the batch number, manufacturing date and expiry date on the product label and in your sale records. The FBR digital invoice does not carry them:
1. Expiry Date Compliance
You must not sell expired medicines. That is a DRAP requirement enforced by drug inspectors, not something FBR checks. The Digital Invoicing API has no expiry-date field, so FBR cannot cross-reference an invoice date with a batch expiry.
What to keep in your own records for each sale:
- Batch/lot number
- Manufacturing date
- Expiry date
- The FBR invoice number of the sale, so the two records can be matched
If a customer needs the batch number on the printed invoice, it can go in the item description, which FBR accepts as free text.
2. Recall Traceability
If DRAP issues a recall for a batch, your own batch records show which distributor or hospital received it, and your FBR invoices give the dates and quantities per buyer:
- Which buyers received the batch
- How many units each buyer received and when
- Which units are still in your own stock
Your responsibility: Keep batch data linked to invoice numbers so a recall can be handled from your records.
3. Controlled Substances
Some medicines are controlled (for example opioids and certain sedatives). Their sale is authorised under the Control of Narcotic Substances Act 1997 and provincial rules:
- Licensing: Seller and buyer need the relevant authorisations before the sale
- FBR invoice: The same digital invoice as for any other medicine; there is no licence field
- Verification: FBR does not check narcotics licences; the responsible authority does
Pharmaceutical Invoice Structure
Here is the structure of a compliant pharmaceutical digital invoice (figures are illustrative):
Invoice no: PH-0001 (your own numbering, set per financial year)
Seller: ABC Pharma | NTN: 1234567
Buyer: XYZ Hospital | NTN: 7654321 | Registration type: Registered
Line Items:
| Medicine | Qty | UoM | HS Code | Sale type | Value | Sales tax |
| Amoxicillin 500mg capsules | 10,000 | Numbers, pieces and units | 3004.1000 | Non-Adjustable Supplies | 50,000 | at the fixed Eighth Schedule rate |
| Insulin 100 IU vial | 500 | Numbers, pieces and units | 3004.3100 | Non-Adjustable Supplies | 150,000 | at the fixed Eighth Schedule rate |
| Cough syrup 100ml | 5,000 | Numbers, pieces and units | 3004.9000 | Non-Adjustable Supplies | 60,000 | at the fixed Eighth Schedule rate |
Totals:
Value of supply: 260,000
Sales tax: calculated from the rate FBR returns for the sale type and invoice date
FBR Data:
FBR invoice number: returned by FBR and printed on the invoice with a QR code
Not on the FBR invoice: batch number, manufacturing date, expiry date, DRAP registration number (kept in your own records)
Key difference from standard invoices: the sale type and rate. Batch, manufacturing and expiry dates are your regulatory records, not FBR fields.
Drug Registration & Compliance
DRAP Registration Requirement
Every medicine sold in Pakistan must be registered with DRAP, and manufacturers, importers and distributors need the relevant licences. On the FBR side:
- Registration number: Keep the DRAP registration certificate for each product in your records
- FBR invoice: There is no registration-number field; FBR does not reject an invoice for a missing DRAP number
- Inspections: DRAP and provincial inspectors check registration and licences against your sale records
Consequence of selling an unregistered drug: action by DRAP under the drug laws. FBR's digital invoice is not the control point for this.
Banned/Restricted Medicines
Some medicines are banned or restricted by DRAP. Selling them:
- Violates DRAP regulations
- Is not detected by FBR invoice validation
- Can lead to action under the drug laws
Safeguard: Maintain an up-to-date list of registered products and check it before a product is added to your invoicing system.
Common Pharmaceutical Compliance Mistakes
Mistake #1: Charging the Standard Rate on a Fixed-Rate Drug
Problem: "Charged 18% on registered medicines." The rate and sale type are wrong, and FBR returns an error when the calculated tax does not match the rate for the sale type.
Fix: Use the "Non-Adjustable Supplies" sale type and take the rate from FBR's rate list for the invoice date.
Mistake #2: Wrong HS Code
Problem: "Used HS code 3006 (pharmaceutical goods) instead of 3004 (medicaments)." The code does not match the sale type.
Fix: Pick the 8-digit code from FBR reference data and save it on the product so every invoice reuses it.
Mistake #3: Missing Schedule Reference on Reduced-Rate or Exempt Items
Problem: "Invoiced an exempt item without the schedule and serial number." FBR returns error 0077 or 0078.
Fix: Select the SRO schedule and item serial number that justify the rate for each reduced-rate, zero-rated or exempt item.
Mistake #4: Government Hospital Invoiced Without FTN or Withholding
Problem: "Invoiced a government hospital as an ordinary registered buyer." Government bodies hold an FTN and usually withhold sales tax at source.
Fix: Record the FTN on the customer and apply the sales tax withheld at source option that applies to the buyer.
Mistake #5: Wrong Buyer Verification
Problem: "Invoiced a hospital with an incorrect NTN." FBR returns error 0053 (registration type does not match the buyer's profile). See the Buyer Verification Guide.
Fix: Check the NTN through FBR's registration service when the customer is created, and keep one record per buyer.
Pharmaceutical Multi-Channel Distribution
Most pharma companies distribute through several channels. The FBR invoice differs by buyer type:
| Channel | Buyer Type | Invoice Requirement | Compliance Note |
|---|---|---|---|
| Direct to Hospital | Private hospital (registered) or government hospital (FTN) | NTN or FTN; registration type; sales tax withheld where the buyer is a withholding agent | Government hospitals usually withhold |
| Direct to Pharmacy | Registered or unregistered retailer | NTN (7 digits) or CNIC (13 digits); registration type set correctly; further tax where applicable | Pharmacy drug sale licence is a DRAP/provincial matter |
| Distributor Network | Registered wholesale distributor | NTN; registration type Registered | The distributor issues its own digital invoices onward |
| Government Tenders | Provincial health department (FTN) | FTN on record; sales tax withheld at source as applicable | FBR's registration service treats FTN holders as Unregistered |
| Export | Foreign buyer | Zero-rated sale type with the schedule reference FBR expects; customs Goods Declaration | No NTN; export permissions from DRAP as applicable |
Each channel has different buyer verification requirements. See the Multi-Channel FBR Invoicing guide.
Pharmaceutical Audit Preparation
Here is what an FBR audit of a pharmaceutical seller will look at, alongside the DRAP records you keep separately:
FBR Pharmaceutical Audit Checklist
- [ ] Invoice accuracy: Every sales invoice carries an FBR invoice number and matches what appears on IRIS
- [ ] HS codes: All medicines use the correct 8-digit pharmaceutical codes (chapter 30)
- [ ] Sale type and rate: Registered drugs invoiced under the fixed Eighth Schedule rate; other items at the rate the schedule/SRO gives
- [ ] Schedule references: SRO schedule and item serial recorded on reduced-rate, zero-rated and exempt items
- [ ] Buyer verification: Registration types match FBR's records; FTN buyers have withholding applied
- [ ] Returns and corrections: Edits and cancellations made on IRIS within the 72-hour window; later adjustments documented
- [ ] Inventory reconciliation: Invoiced quantities match stock records
- [ ] DRAP records: Batch, expiry and registration data kept separately and linked to invoice numbers
- [ ] Record retention: Six years of records available under the Sales Tax Act

FAQ: Pharmaceutical Invoicing
Q: Does FBR reject an invoice without a batch number?
A: No. The Digital Invoicing API has no batch-number or expiry-date field. Batch tracking is a DRAP requirement that lives in your own records; link each batch to the FBR invoice number of the sale.
Q: What if a batch is partially expired (some units still within date)?
A: Only the units within date may be sold, so only those appear on an invoice. The expired units are handled under DRAP destruction rules in your stock records. FBR does not see the split.
Q: Which sandbox scenarios does a pharmaceutical seller need?
A: IRIS lists the eligible scenarios for the business nature and sector you selected. Pharmaceutical sellers typically see the common set plus SN025 (drugs at the fixed rate). See FBR sandbox scenarios.
Q: What happens if a medicine is recalled after I have invoiced it?
A: The sale has already been reported. If the recall falls within the 72-hour window, the invoice can be edited or cancelled on IRIS. After that, the Digital Invoicing API supports debit notes that reference the original FBR invoice number within 180 days, and credit notes are handled on IRIS. FinSmart does not issue debit or credit notes today, so record the return in your own records and agree the tax adjustment with your tax adviser.
Ready to Get Pharma Compliance Right?
Pharmaceutical invoicing needs precision on the FBR side (HS code, sale type, rate, buyer type) and on the DRAP side (registration, batch, expiry). Keeping the two sets of records linked by the FBR invoice number is what makes audits and recalls manageable.
FinSmart handles the FBR side: validation against FBR reference data, the fixed-rate sale type, buyer registration checks and the FBR invoice number and QR code on every invoice.
